A Conditional Use Hearing was held at 6:30 PM for 4060 Edges Mill Road prior to the start of the Work Session.
Call to order and pledge of allegiance.
Attendance – Jennifer Breton-President, George Chambers-Vice President, John Contento-Commissioner, Joshua Young-Commissioner, Lorraine Tindaro-Commissioner, Kristen Denne-Township Manager, Kristin Camp-Township Solicitor, Township Engineer-Bryan D. Kulakowsky, and Jennifer Schwed-Recording Secretary.
Absent – Township Treasurer-Chuck Wilson
Citizens to Be Heard
Commissioner Breton called for any citizens to be heard. There were none.
Township Solicitor-Kristin Camp
Township Solicitor Kristin Camp reviewed the ordinance in process which would allow the application for a permit to open or excavate a road in the township right of way. A marked-up draft of the amendment was provided to the Board for review and discussion after being reviewed by Township Manager Denne and Ray Stackhouse. The ordinance would amend Section 134 of the Caln Township Code titled “Streets and Sidewalks.”
Solicitor Camp provided an update on the ordinance being drafted to create a new I-2 district which will rezone 4 properties including the property belonging to David Gilgem. Mrs. Camp would like to present the finished ordinance to the Board at the meeting held on 2/8/18. The Board would then hold a hearing at the meeting held on 2/22/18.
Commissioner Breton entertained a motion to schedule a vote on the ordinance creating a new I-2 district for the second Board of Commissioner’s meeting in February (2/22/18). Motion made by Commissioner Contento and seconded by Commissioner Chambers. Motion passed, 5-0.
Solicitor Camp introduced representatives from NTB (National Tire and Battery) Development, 3453 Lincoln Highway. NTB is seeking approval of several exceptions and variances to existing township code for the property to construct a 6,158-square foot building with parking and storm water management. Attorney for the applicant, Debra Shulski and the developer presented sketch plan modifications which include parking space sizes and numbers, lot perimeter set back exceptions, non-conforming use due to the location being under an acre, and impervious cover exceeding 80%. The individuals sought guidance from the Board on the plan modifications. After a discussion surrounding the daily operations of NTB stores elsewhere, the Board still expressed concern over 17 parking spaces instead of the required 31 under code and asked for further due diligence on the matter on behalf of NTB to be presented to the Board at a future meeting. The Board agreed to vote on all the requested plan modifications upon further presentation at the next meeting.
Solicitor Camp presented a proposed church called Christian Faith Fellowship which is in the R2 zoning district. The church falls under a special exception zoning application and has received special exception approval. One of 3 conditions placed on the facility was the requirement to connect the property to a public water line. The church is seeking a variance request on the condition from the Board. The Board requested the applicant provide detailed specifications which include water containment systems required for fire safety and usage.
Solicitor Camp presented a request for a conditional use hearing for 4533 W. Lincoln Highway (Chester County Sports Arena) for a children’s daycare/after school program. Solicitor Camp proposed the hearing being held at 6:30 PM prior the 2/8/18 meeting. The Board agreed to meet at that time for the hearing.
Solicitor Camp presented an ordinance adopting a new article and section to Chapter 134 titled “Removal of Diseased or Dangerous Trees from Public Streets and Public Right of Ways.” The proposed ordinance was advertised in the Daily Local on 1/3/18 and a copy was sent to the Chester County Law Library. Commissioner Contento requested a clarification in the document to be added to paragraph “C” stating that the vegetation will imminently fall into the roadway. Existing language in paragraph “C” will be rearranged to read “remove the obstruction or abate the hazardous condition.”
Commissioner Breton entertained a motion to adopt the ordinance for the removal of diseased or dangerous trees from public streets and public right of ways with the noted language change. Motion made by Commissioner Chambers and seconded by Commissioner Contento. Motion passed 5-0.
Township Manager-Kristen Denne
Township Manager Kristen Denne noted that the RFP’s came back for a new Township Auditor and were being reviewed by Ms. Denne and Treasurer Chuck Wilson. Ms. Denne provided the Board with copies of the received RFP’s and requested a decision be made by the Board meeting held on 2/25/18.
Manager Denne presented a sketch plan to erect an 800-square foot pole barn on property in Caln Municipal Park by the Caln Athletic Association. The Board was in favor of the plan as long as the athletic association cover any costs incurred by the township and they would replant any trees that may need to be removed in the process.
Manager Denne noted the Municipal Authority is applying for a Small Water and Sewer Program Grant for the Granger Lane/Caln Meeting House Road area. The Planning Commission and Board of Commissioners have drafted letters expressing their support of the program.
In addition, the Municipal Authority wants to put a notice in the paper to remind residents that they will have to connect to the new sewer system (Dogwood/Scott Project).
Manager Denne discussed the request to add a stop sign travelling north on Barley Sheaf Road. The results of a PennDOT study concluded a 1-way stop sign should be added travelling north to alleviate problems with drivers making a left-hand turn. Solicitor Camp will advertise to amend the current traffic with the Board’s approval.
Commissioner Breton entertained a motion to advertise an amendment to the Caln Traffic Ordinance relating to the Barley Sheaf stop sign. Motion made by Commissioner Contento and seconded by Commissioner Tindaro. Motion passed, 5-0.
Township Engineer-Bryan Kulakowsky
Bryan Kulakowsky of Cedarville Engineering Group introduced himself as the new Caln Township Engineer replacing Carol Schuehler.
Mr. Kulakowsky provided an update on the site inspection conducted at the Woods at Rock Raymond Road and noted the HOA was permitted to participate along with the developer. The inspection was conducted on 12/18/17 and a letter was issued dated 1/4/18 with a list of items that require attention or correction.
Mr. Kulakowsky noted that the permit application has been submitted with the DEP for the Fisherville Road Bridge project and he anticipates hearing back in the middle of February.
Ordinances and Resolutions for Consideration
Resolution Endorsing Completion of Circuit Trails-Commissioner Breton entertained a motion to adopt the resolution endorsing the completion of circuit trails. Motion made by Commissioner Young and seconded by Commissioner Chambers. The Board noted the resolution endorses the concept of completing the trails but does not monetarily obligate the township to any specific action.

Commissioner Breton entertained a motion to approve general checks 40943 through 41011 voiding checks 40947 through 40950 and Bond checks 1179 & 1180. Motion made by Commissioner Contento and seconded by Commissioner Tindaro. Approved, 5-0.

Commissioner Breton entertained a motion to approve the Minutes from the BOC meeting on November 30, 2017. Motion made by Commissioner Young and seconded by Commissioner Contento with Commissioner Tindaro abstaining. Approved, 4-0 with 1 abstention.

Municipal Authority-Commissioner Chambers noted that the Dogwood/Scott project is doing well, and they are pursuing a grant for the Granger Lane area.

Fire Board-Commissioner Young noted all the new officers were sworn in including John Carbo as the president and Marlene Taylor as the chairman.
Civil Service Commission-Manager Denne noted that interviews for new police officers are underway with 26 eligible applicants. Scores are being compiled and a final list for certification will be presented.
Planning Commission –No update
Historical Commission-Commissioner Tindaro said the topic at the last meeting was 4060 Edges Mill Road.
Zoning Hearing Board-No update
Additional Business
Commissioner Breton noted that the Board would hold an Executive Session meeting after tonight’s meeting to discuss personnel matters.
Commissioner Breton requested that staff put together the resumes for the applicants for the Planning Commission for the Board to vote on at the 1/25/18 meeting.
Commissioner Breton entertained a motion to adopt the Resolution appointing Kristen Denne as the Township Secretary. Motion made by Commissioner Contento and seconded by Commissioner Tindaro. Approved, 5-0.
Commissioner Breton entertained a motion to adopt the Resolution appointing Abbey Swan as the Right to Know Officer for Caln Township. Moved by Commissioner Contento and seconded by Commissioner Chambers. Approved, 5-0.
Public Comments
Commissioner Breton called for any public comments.
A representative from the Wedgewood Estates HOA asked about check #1180 on the Bill List labeled “Wedgewood” in the amount of $4,500. Township Manager Denne stated the check was for a PennDOT permit for grading. Ms. Denne explained that Right of Way of requests for the sidewalk project have been sent to the business owners on the planned route to see how they would like to proceed.
